March 27, 2015 Opinion or Order Filing 7 ORDER GRANTING IN PART AND DENYING IN PART DEFENDANTS MOTION TO DISMISS. Defendants Motion to Dismiss Pursuant to Fed. R. Civ. [P.] 12(c) ECF No. 4 is GRANTED in part and DENIED in part. All claims against Defendants Spokane County Regional Anim al Protection Service (SCRAPS) and Officer Faylor are dismissed. Plaintiffs intentional infliction of emotional distress and negligent misrepresentation claims are dismissed. Defendants Motion as to all other claims is DENIED. Plaintiff is GRANTED leave to file an amended complaint within thirty (30) days of the entry of this order. Pursuant to Federal Rule of Civil Procedure 81(c), this Court orders that any demand for a jury trial be filed within thirty (30) days of the entry of this order. Signed by Judge Thomas O. Rice.
