King's motion for leave to amend her counterclaim, docket no. 23 , is DENIED; Allstate's motion for summary judgment, docket no. 21 , as to King's counterclaim is GRANTED, and King's counterclai m is DISMISSED with prejudice; Allstate's separate request that this action be dismissed pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii) is DENIED without prejudice. The court DIRECTS the parties to file a Joint Status Report, within fourteen (14) days of the date of this Order. (CL)
