ORDER - The Report and Recommendation, docket no. 33, is ADOPTED. Defendants' motion for summary judgment, docket no. 13, is GRANTED in part and DENIED in part. Plaintiff's complaint, docket no. 4, and this action are DISMISSED without prej udice for failure to exhaust administrative remedies before filing suit. The Court DECLINES to enter judgment against plaintiff or in favor of defendants, and DENIES defendants' request to treat this matter as a strike against plaintiff pursuant to 28 U.S.C. § 1915(g). The Clerk is DIRECTED to CLOSE this case and to send copies of this Order to plaintiff pro se, to all counsel of record, and to the Honorable Mary Alice Theiler.
