MINUTE ORDER entered at the direction of Judge Theresa L Fricke: On March 23, 2023, the Court notified the parties regarding the assignment of this case to a United States Magistrate Judge. The parties were notified they may decline consent by signing at the bottom of the form, and if they did not provide the signed form to the Court by April 22, 2023, the Court would deem that the parties had consented. Dkt. #7 . Neither party has opted out; therefore, it is the Court's understanding that all parties have thus affirmatively consented. The Court however will confirm the consent of the parties as follows:The parties are directed to advise Deputy Clerk, Gayle Riekena, of their affirmative consent to the jurisdiction of the United States Magistrate Judge -- by sending the attached form by email to Ms. Riekena at the following email address: gayle_riekena@wawd.uscourts.gov, or by faxing the form to Ms. Riekena at 253-882-3829, or by mailing it to Ms. Riekena at the following address: U.S. District Court, 1717 Pacific Avenue, Room 3100, Tacoma, WA 98402. The form must be received by the Court no later than June 1, 2023. Please Note: Forms must not be electronically filed with the Court.Consent to a Magistrate Judge is voluntary. If any party does not consent, the identity of the party that does not consent will not be communicated to any judge, and the case will be reassigned to a United States District Judge. If the Court does not receive the forms from every party, showing that all parties affirmatively consent -- on or before June 1, 2023 then the United States Magistrate Judge will no longer be assigned to the case, and the case will be handled by a United States District Judge. If the Court receives forms from every party, showing that all parties affirmatively consent, then the United States Magistrate Judge will decide the pending motion to dismiss (Dkt. #10 ) and will not submit a Report and Recommendation for the United States District Judge; and the United States Magistrate Judge will be assigned to the case for all purposes, including trial, final entry of judgment, and direct review by the Ninth Circuit Court of Appeals.
