May 14, 2015 Opinion or Order Filing 72 ** TEXT ONLY ORDER **Defendants have moved for summary dismissal of plaintiffs' motion for preliminary injunction on the grounds that plaintiffs' motion is formally defective, principally because they have not submitted a list of proposed facts. Dkt. #60 . I will deny the motion. Because of the unusual circumstances of this case, I set an expedited briefing schedule and prompt hearing on plaintiffs' motion. In setting that schedule, I did not require and did not expect that the parties would follow the usual formalities of this district's procedures on preliminary relief. Although I am allowing some procedural flexibility on plaintiffs' motion, basic rules of fair play still apply: neither side will prevail by sandbagging the other. At tomorrow's hearing, the parties should present the evidence and argument I need to decide plaintiffs' motion correctly. Defendants' motion, Dkt. #60 , is DENIED.
