MEMORANDUM OPINION AND ORDER GRANTING IN PART and otherwise DENYING 25 MOTION to Dismiss for Lack of Jurisdiction and Failure to State a Claim, DENYING 31 MOTION for Default Judgment. Accordingly, Mr. Craig Cerise and Ms. Lynette Otto are both HEREBY DISMISSED WITHOUT PREJUDICE for lack of personal jurisdiction. Additionally, Counts Seven, Eight, and Nine of Mr. Tinsley's Amended Complaint are HEREBY DISMISSED WITH PREJUDICE.
