Filing 58 MEMORANDUM OPINION, AND ORDER For the foregoing reasons, the court GRANTS IN PART and DENIES IN PART Bakers motion for summary judgment. The court ENTERS SUMMARY JUDGMENT in favor of Baker and against the Blankenships on Counts II and IV of the a mended complaint because no evidence in the record supports these claims. The court DENIES the motion as to the remaining claims and the court DENIES the Blankenships motion for partial summary judgment because a jury must determine whether the floor mat constituted an open and obvious danger.
