ORDER - On December 3, 2018, Petitioner Glen Edward Ray, Jr., filed a petition for writ of habeas corpus pursuant to 28 U.S.C. 2855 naming Jeff Dunn, Commissioner, Alabama Department of Corrections as Respondent and submitted a request for service by certified mail directed to Dunn. (Docs. #1 & #2 ). On December 21, 2018, Petitioner filed an Amended Petition for Writ of Habeas Corpus under 28 U.S.C. 2255 naming only United States of America as the Respondent. (Doc. #3 ). He seeks relief from a March 30, 2016, federal conviction and sentence for Trafficking in Cocaine, not a state conviction. (Doc. #3 at 2). See also, (Doc. #3 -1 at 7), United States of America, v. Glen Edward Ray, Jr., Case No. 1:15-cr-00184-AKK-SGC-1 (N.D. Ala.). On January 3, 2019, the Clerk of Court issued a summons of process directed to the United States. (Doc. 4 ). The Clerk is FURTHER DIRECTED to open a new 28 U.S.C. 2255 case, file the original amended petition and summons in the new case, and assign it to the sentencing judge for resolution as a motion to set aside or vacate a federal conviction or sentence.
