Date Filed Document Text
March 2, 2020 Opinion or Order Filing 7 ORDER TO SHOW CAUSE - In Mr. Marable's second amended complaint, he reasserts the same factual allegations but changes the defendant from the Calhoun County Jail to Calhoun County, Alabama. (Compare Doc. #4 with Doc. #6 ). However, as the court will explain below, Calhoun County is not subject to liability for the actions of the Jail's employees or policymakers, and Mr. Marable's factual allegations do not appear to state a claim under the Americans with Disabilities Act. Accordingly, the court ORDERS Mr. Marable to SHOW CAUSE, in writing, on or before March 16, 2020, why the court should not dismiss the second amended complaint for failure to state a claim. Signed by Judge Annemarie Carney Axon on 3/2/2020. (KEK)
February 27, 2020 Filing 6 SECOND AMENDED COMPLAINT against Calhoun County Jail, Calhoun County, Alabama, filed by Tyler Marable.(KEK) Modified on 2/27/2020 (KEK).
February 6, 2020 Opinion or Order Filing 5 ORDER TO SHOW CAUSE - For the reasons set out below, the court DISMISSES Mr. Marable's request for injunctive relief WITHOUT PREJUDICE for lack of standing. The court ORDERS Mr. Marable to SHOW CAUSE, in writing, on or before March 5, 2020, why the court should not dismiss the rest of his complaint for failure to state a claim. Signed by Judge Annemarie Carney Axon on 2/6/2020. (KEK)
January 29, 2020 Filing 4 AMENDED COMPLAINT against Calhoun County Jail, filed by Tyler Marable.(KEK)
January 23, 2020 Opinion or Order Filing 3 ORDER - Because Mr. Marable's affidavit attached to his application to proceed in forma pauperis demonstrates that he is unable to prepay the filing fee or give security, the court GRANTS the motion to proceed in forma pauperis. (Doc. #2 ). The court DEFERS RULING on the motion to appointment counsel. (Doc. #2 ). The complaint gives no indication that Mr. Marable himself faces a real and immediate threat of detention at the Calhoun County Jail. (See Doc. #1 ). Accordingly, the court ORDERS Mr. Marable to SHOW CAUSE, in writing, on or before March 5, 2020, why the court should not dismiss this complaint for lack of standing. Signed by Judge Annemarie Carney Axon on 1/23/2020. (KEK)
