ORDER denying #391 Motion to Clarify. The pending motion is not a potentially dispositive motion, and the court is perplexed that anyone would call it that. A dispositive motion is a motion that decides, that is, finally determines, a case. The motion that is now pending before the court asks the undersigned judge to recuse herself (that is, remove herself from the case) and to vacate (that is, nullify) the prior final judgment order that the EPA agreed necessarily resulted from the court's decision to exclude the EPA's experts' opinions as litigation-based rather than scientifically based. That decision, which was itself greatly influenced by a decision of the Seventh Circuit Court of Appeals (Posner, J.) as to the same methodology and EPA experts, is currently on appeal to the Eleventh Circuit Court of Appeals.If the pending motion is granted, the case will not be finally decided. In fact, the now-decided case would become undecided. As the parties well know, if the pending motion is granted, Alabama Power's Motion to Exclude (EPA's experts' opinions) and the various cross motions for summary judgment that were extensively briefed and argued, with an evidentiary hearing, would need to be decided, just by a different district court judge than the undersigned judge. Those motions, unlike the pending motion, are potentially dispositive motions.Further, as the parties know, there is no right to file a reply brief; indeed, reply briefs are not even contemplated by the Rules of Civil Procedure.The court's prior order was clear.
