May 14, 2009 Opinion or Order Filing 9 MEMORANDUM AND ORDER IT IS HEREBY ORDERED that defendant's motions to drop plaintiffs, or in the alternative to sever and transfer, and to dismiss for failure to state a claim, are GRANTED in part, and DENIED, in part, as moot. The motions are g ranted to the extend the Court finds the plaintiffs have been misjoined. All but the resident plaintiff, Stephanie Sorocko, shall be dropped from this suit and dismissed without prejudice. In all other respects, the motions are denied, without prejud ice, as moot. [Doc. 2]IT IS FURTHER ORDERED that plaintiff Stephanie Sorocko shall file an amended complaint consistent with the terms of this Memorandum and Order within twenty (20) days of the date of this Memorandum and Order.
