The court futher ACCEPTS the Recommendations of the Magistrate Judge. It is therefore, ORDERED, ADJUDGED, and DEC REED that the Motion for Partial Judgment on the Pleadings 23 is due to be and hereby is GRANTED. The claims set out in this order are hereby DISMISSED WITH PREJUDICE.
