Filing 31 MEMORANDUM OPINION - For the reasons stated above, the Court DISMISSES the Boards claims WITH PREJUDICE. With the exception of the claim for attorneys fees, the Court DISMISSES Bryan and Darcys claims WITH PREJUDICE. On or before October 27, 2016, Br yan and Darcy shall submit to the Court evidence of their attorneys fees attributable to the due process proceedings. The Board may respond with arguments for limiting those fees on or before November 7, 2016. Bryan and Darcy may reply on or before November 14, 2016. Filing 20 MEMORANDUM OPINION - The Jefferson County Board of Education is not an arm of the state, and therefore it is not entitled to sovereign immunity under the Eleventh Amendment for purposes of this IDEA proceeding.
