Filing 33 MEMORANDUM OPINION - For the reasons explained above, no genuine issue of material fact exists with respect to the following claims: (1) Ms. Litakers Title VII claim against Mr. Craig; (2) Ms. Litakers § 1983 due process claim against Ms. Barber in her official and individual capacity; (3) Ms. Litakers § 1983 due process claim against Mr. Craig in his official capacity; (4) Ms. Litakers breach of contract claim against the Board; and (5) Ms. Litakers defamation claim against Mr. Craig and Ms. Barber. Therefore, the defendants are entitled to judgment as a matter of law on these claims. Genuine issues of material fact preclude summary judgment on Ms. Litakers Title VII claim against the Board and her § 1983 due process claim against the Board and Mr. Craig in his individual capacity. By separate order, the Court will set these claims for a jury trial. Signed by Judge Madeline Hughes Haikala on 9/29/2017. (KEK) |
