Filing 18 MEMORANDUM OPINION AND ORDER- It is ORDERED that the defts' motion for summary judgment is GRANTED IN PART and DENIED IN PART (Doc 13 ); Specifically, genuine issues of material fact preclude judgment as a matter of law on the claim of excessiv e force brought against Officer Marchello Henry in his personal capacity; summary judgment is DENIED as to this claim; There are no genuine issues of material fact concerning any of the remaining claims, and the defts are entitled to judgment as a matter of law; Accordingly, summary judgment is GRANTED as to the remaining claims.
