Accordingly, by separate order, the Court will enter judgment for the City of Birmingham on Officer Minnifield's remaining Title VII claims because Officer Minnifield has not established a prima facie case of discrimination or retaliation. Filing 70 MEMORANDUM OPINION AND ORDER - For the reasons discussed above, the Court DENIES the defendants motion to strike. (Doc. 65). Additionally, the Court GRANTS IN PART and DENIES IN PART the defendants motion for summary judgment. (Doc. 41). The Court strikes Mr. Minnifields demand for punitive damages from the City.
