MEMORANDUM OPINION AND ORDER GRANTING IN PART and DENYING IN PART 40 MOTION to Dismiss, GRANTING IN PART and DENYING IN PART 44 MOTION to Dismiss. Specifically, the City's motion is DENIED. The officers' motion is GRANTED as to all of t he Plaintiff's claims relating to his removal from the vehicle and otherwise is DENIED without prejudice.
