MEMORANDUM OPINION AND ORDER - For the reasons explained above, the Court grants Regionss motion in part and dismisses Counts I and II of Mr. Toscanos second amended complaint. The Court dismisses Mr. Toscanos claim in Count V to the extent that he p remises this claim on retaliation for his reports of fraudulent business practices. The Court also dismisses Mr. Toscanos claim in Count VI for breach of contract to the extent that he premises that claim on Regionss failure to provide outplacement s ervices or benefits covered by ERISA. Finally, the Court strikes Mr. Toscano jury demand based on his contractual waiver of that right. The Court defers its decision on Mr. Toscanos Dodd-Frank Whistleblower claim in Count IV.
