MEMORANDUM OPINION - For the reason discussed above, the Court denies Mr. Jaramillo-Echeverria's motion to vacate his conviction under 28 U.S.C. § 2255 based on his Johnson claim and his claims of ineffective assistance of counsel based on his attorney's failure to negotiate a plea and on his attorney's advice to change his plea from not guilty to guilty. The Court will resolve Mr. Jaramillo-Echeverria's ineffective assistance of counsel claims regarding his appeal rights after an evidentiary hearing.
