June 21, 2019 Opinion or Order Filing 25 MEMORANDUM OPINION - There being no genuine issue of material fact, the evidence establishes that Baker did not file this lawsuit within ninety days of receiving adequate notice that the EEOC had dismissed his charge, i.e., the initial Right t o Sue Letter. Accordingly, Baker has failed to carry his burden to establish the timeliness of his Title VII claims, and this action will be dismissed. A separate order will be entered.
