ORDER The court lacks subject matter jurisdiction over Burkett's claim, it is DISMISSED WITHOUT PREJUDICE against Defendants Fields, Montgomery, and Coolidge for Burkett to pursue his claims against these defendants in state court. Because Burkett does not plead any facts showing that Jay Town had any involvement in the alleged conduct, the claims against Town for this alleged conduct is DISMISSED WITH PREJUDICE.
