ORDER- The court previously entered an order dismissing without prejudice the plaintiffs fraud claim, dismissing with prejudice the plaintiffs other claims against Taurus International Manufacturing, Inc. and Taurus Holdings, Inc., and remanding the remaining claims to state court #12 . As such, the plaintiffs motion to extend, #14 , is MOOT. To the extent that plaintiff believes the courts dismissal is in error, he is free to move to reconsider within the relevant time period prescribed by the Federal Rules of Civil Procedure. ORDER OF DISMISSAL-For all these reasons, the moving defendants motion to dismiss, #3 , is GRANTED. Because in theory the plaintiff may be able to plead facts to invoke the savings clause for his fraud claims, those claims are DISMISSED WITHOUT PREJUDICE. The rest of his claims against Taurus International Manufacturing, Inc. and Taurus Holdings, Inc. are DISMISSED WITH PREJUDICE. The claims against the remaining defendants, Forjas Taurus, S.A. and Scotts Jewelry and Pawn, are REMANDED back to the Circuit Court of Jefferson County,Bessemer Division.
