January 6, 2022 Opinion or Order Filing 35 PAPERLESS ORDER. THIS CAUSE came before the Court upon the Parties' Joint Motion for Extension of Time to Respond to Complaint. #34 . On November 8, 2021 the Judicial Panel on Multidistrict Litigation ("JPML") entered a conditional transfer order that would transfer this case to the Northern District of Alabama. Id. at 2. The Parties inform the Court that Plaintiffs have filed a motion to vacate the conditional transfer order. Id. at 2. Briefing on Plaintiffs' motion before the JPML concluded on December 27, 2021, and the motion is scheduled for submission on January 27, 2022. Id. at 2-3. Thus, the Parties request that Defendants be permitted to respond to Plaintiffs' Complaint on or before March 11, 2022 while the process before the JPML proceeds. Id. at 3. Although this is the Parties' third request for an extension of time, see (ECF Nos. 29, 32, 34), the Court finds good cause for the instant, timely request for an extension of the deadline to respond to the Complaint. See Fed. R. Civ. P. 6(b). Moreover, "[d]istrict courts have 'unquestionable' authority to control their own dockets." Smith v. Psychiatric Sol., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (internal citation omitted). "This authority includes 'broad discretion in deciding how best to manage the cases before them.'" Id. (internal citation omitted). Accordingly, the Court finds good cause to administratively close this case until the JPML enters an order on Plaintiffs' pending motion to vacate the conditional transfer order. Accordingly, UPON CONSIDERATION of the Joint Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Parties' Joint Motion for Extension of Time to Respond to Complaint #34 is GRANTED IN PART and DENIED IN PART. Defendants shall have an extension of time as further set forth herein. It is further ORDERED that this case shall be administratively closed until further notice. The Clerk of Court is INSTRUCTED to ADMINISTRATIVELY CLOSE this case. The Parties may move to reopen this case upon the filing of Defendants' responses to Plaintiffs' Complaint #1 . Defendants' responses to Plaintiffs' Complaint shall be due within fourteen (14) days of the entry of an order by the JPML granting Plaintiffs' motion to vacate the conditional transfer order. It is further ORDERED that the Parties shall hold a scheduling conference that complies with this Court's Pretrial Order (ECF No. 4) within twenty (20) days of the entry of an order by the JPML granting Plaintiffs' motion to vacate the conditional transfer order. Plaintiff's counsel is hereby ORDERED to forward to all defendants, upon receipt of a responsive pleading, a copy of this Order. It is further ORDERED that S.D. Fla. L.R. 16.1 shall apply to this case and the parties shall hold a scheduling conference no later than twenty (20) days after the filing of the first responsive pleading by the last responding defendant, or within sixty (60) days after the filing of the complaint, whichever occurs first. However, if all defendants have not been served by the expiration of this deadline, Plaintiff shall move for an enlargement of time to hold the scheduling conference, not to exceed 90 days from the filing of the Complaint.
