June 2, 2022 Opinion or Order Filing 7 ORDER - Because the court was unsure whether the complaint adequately alleges Ms. Oswalt's standing, the court ordered Trans Union to show cause why the court should not remand the case for lack of subject matter jurisdiction. (Doc. #5 ). Trans Union argues that Ms. Oswalt has alleged an injury in fact because the complaint states that she suffered "past and future monetary loss, past and future damage to Plaintiff's credit and credit worthiness, past and future mental distress and emotional anguish, and other damages." However, at this stage, the court agrees with Trans Union that Ms. Oswalt's allegation of "past and future damage to [her] credit and credit worthiness [and] past and future mental distress and emotional anguish" are sufficient to plausibly support standing. If, however, evidence does not support standing at later stages of the proceedings, the court will be required to remand this case. Signed by Judge Annemarie Carney Axon on 6/2/2022. (KEK)
