Filing 10 TEXT ORDER. Before the court are two motions filed by Defendant Local 78 of the International Alliance of Theatrical Stage Employees: a #3 motion to dismiss the complaint and a #7 motion to stay Federal Rule of Civil Procedure 26 obligations. Response to the motion to dismiss #3 is due on or before March 31, 2023; a reply, if any, is due on or before April 7, 2023. The court notes that the length of the motion to dismiss exceeds the thirty-five page limit permitted by this court. However, because the court had not entered its initial order when Local 78 filed its motion, the court will not strike the motion. Instead, the court will permit Plaintiff Jody McCluskey to file a response brief that is no more than forty-four pages in length, excluding any table of contents. Local 78s reply brief, if it files one, must not exceed the courts page limitation. The court DENIES the motion to stay the parties Rule 26 obligations.
