Motions terminated: #2 MOTION for Leave to Proceed in forma pauperis - per #3 Order. (SAC) |
Filing 3 ORDER Plaintiff Carlos Cole, who is proceeding pro se, filed his complaint on February 12, 2024. (Doc. 1). Mr. Cole contemporaneously moved for leave to proceed in forma pauperis. (Doc. 2). Because Mr. Cole's motion to proceed in forma pauperis is incomplete, the court DENIES the motion WITHOUT PREJUDICE to his opportunity to renew the motion on or before February 29, 2024. The court also ORDERS Mr. Cole to file an amended complaint on or before February 29, 2024. The amended complaint should state how the court has subject matter jurisdiction. The amended complaint must contain a separate count for each claim that contains a factual basis for that claim only. Each count should identify: (1) the specific defendant(s) against whom the claim is asserted, and (2) the statute or law under which the claim is brought. The amended complaint must include all of Mr. Cole's claims in this action and must not refer back to the original complaint. The court will consider only claims and factual allegations set forth in the amended complaint. The court WARNS Mr. Cole that failure to comply with this order will result in dismissal of this action. Signed by Judge Annemarie Carney Axon on 2/14/2024. (RMM) |
