ORDER - Sheriff Oliver has not indicated that he has standing to raise defenses on behalf of unserved defendants, and Ms. Wigington is not obligated to plead away affirmative defenses in her amended complaint. Therefore, in keeping with the liberal amendment policy of Rule 15, this Court recognizes Ms. Wigingtons amended complaint and directs the parties to treat Doc. #9 as the operative pleading in this action.
