On September 10, 2024, the court notified Gary Allen Burton that if he wished to pursue his claims of excessive bail, he must file a new federal habeas petition pursuant to 28 U.S.C. 2241. Doc. 4. Mr. Burton has filed his petition, and the Clerk has opened a new section 2241 habeas corpus action for Mr. Burton. Accordingly, the court DISMISSES this action without prejudice.The Clerk is DIRECTED to (1) close this case and (2) make a copy of the application to proceed in forma pauperis, Doc. 2, and docket the application in case 4:24-cv-1263-MHH-GMB.
