MEMORANDUM OPINION AND ORDER that Aerotek's Motion to Dismiss is GRANTED in part and DENIED in part; Quest's Motion for judgment on the pleading is GRANTED in part and DENIED in part; Quest's ALternative Motion to Strike is DENIED and Plainitff's Motion to Strike is DENIED as MOOT; it is ORDERED that Counts 7, 8, and 11 of the amended complaint are DISMISSED with prejudice; all portions of Count 10 that arise from the alleged reporting of Plaintiff's test results to his employer are DISMISSED; all other claims remain pending as more fully set out in order.
