MEMORANDUM OPINION - Consistent with the preceding discussion, the Court grants summary judgment in favor of Price Foods and Wintzells Franchise Company on all of the plaintiffs claims. The Court grants summary judgment in favor of Wintzells Huntsvil le, LLC on the plaintiffs claim for failure to warn. The Court denies summary judgment to Wintzells Huntsville, LLC and to WSI on the plaintiffs claims for violation of the AEMLD, breach of implied warranty of merchantability, negligence, and loss of consortium.
