Filing 107 MEMORANDUM OPINION AND ORDER re 89 - For the reasons discussed above, the Court denies ASSEC's motion for summary judgment. Signed by Judge Madeline Hughes Haikala on 8/26/2021. (KEK) |
Filing 104 MEMORANDUM OPINION - ASSEC has established that it is a public entity, but it has not demonstrated that it is an arm of the state of Alabama. The evidence indicates that ASSEC is an entity separate from the state. Therefore, ASSEC is a citizen for pu rposes of diversity of citizenship jurisdiction, and ASSEC and Odysseia are completely diverse. Accordingly, the Court denies ASSEC's motion for summary judgment (Doc. 89 ) as it relates to subject matter jurisdiction. By a separate memorandum opinion and order, the Court will address the remaining issues raised in ASSEC's summary judgment motion. Signed by Judge Madeline Hughes Haikala on 9/16/2019. (KEK) |

Therefore, ASSEC i s a citizen for purposes of diversity of citizenship jurisdiction, and ASSEC and Odysseia are completely diverse.14 Accordingly, the Court DENIES ASSECs second motion to remand. By separate order, the Court will set a briefing schedule on ASSECs motion to dismiss Odysseias counterclaim. (See Doc. 43). Signed by Judge Madeline Hughes Haikala on 8/19/2016. (KEK) |
