Filing 54 MEMORANDUM OPINION AND ORDER DISMISSING CASE that that the defendants' motions for summary judgment are GRANTED in part, and DENIED in part; it is ORDERED that plaintiff's Fourteenth Amendment substantive due process claim, Eighth Amendment deliberate indifference claim, and 42 U.S.C. § 1985(3) claim are DISMISSED with prejudice; plaintiff's state-law wantonness and breachof contract claims are DISMISSED, but without prejudice to plaintiff's right to re-file those claims in an appropriate state forum and costs are taxed to plaintiff, as more fully set out in order.
