Filing 48 MEMORANDUM OPINION AND ORDER - Having reviewed de novo the record in this case, and for the reasons stated above, the Court orders as follows: (1) The Court dismisses for lack of jurisdiction the Johnsons contempt claim; (2) The Court dismisses the Johnsons negligence, wantonness, conversion, trespass, and declaratory judgment claims for failure to state a claim. (3) On or before September 27, 2018, the Johnsons shall show cause in writing why the Court should not dismiss their FDCPA claims aga inst Mr. Emerson and Mr. Adcock for failure to state a claim because the Johnsons have not adequately pleaded that Mr. Emerson and Mr. Adock are debt collectors within the meaning of the FDCPA.
