MEMORANDUM OPINION AND ORDER - For the foregoing reasons, the Court GRANTS the United States motion to dismiss Mr. Kirklands FTCA claim. The Court DISMISSES the FTCA claim WITH PREJUDICE. The Court postpones a ruling on Auto-Owners motion to dismiss until the Court determines whether it has an independent basis for exercising jurisdiction over Mr. Kirklands state law claim against the insurer.
