Filing 96 MEMORANDUM OPINION AND ORDER - For the reasons discussed above, the Court denies the Army's motion to dismiss and supplemental motion to dismiss, (Docs. 83 , 89 ), as to Count 5. In all other respects, the Court grants those motions and dismis ses the remaining counts (Counts 14, 8) with prejudice. The Court grants the union defendants motion to dismiss, (Doc. 79 ), in its entirety. The following claims are dismissed with prejudice: all claims based on the violation of 18 U.S.C. § 167; 1001 and 1505; all claims against the individual defendants; and all claims in Count 6. The Court dismisses without prejudice the remaining claims against Local 1858, District 5, and the national union so that Mr. Hawthorne may pursue those claims in a proper forum if he wishes.
