Filing 3 TEXT ORDER: Before the Court is Mr. Clark's complaint against Wal-Mart Stores East, LP. Mr. Clark has identified Wal-Mart Stores as a Delaware limited partnership. Mr. Clark alleges that the Court may exercise jurisdiction over his claims pursuant to diversity jurisdiction under 42 U.S.C. 1332(a). With respect to an unincorporated entity like a limited partnership, "diversity jurisdiction in a suit by or against the entity depends on the citizenship of all the members" of the entity. Carden v. Arkoma Assocs., 494 U.S. 185, 195-96 (1990); see also Rolling Greens MHP, L.P. v. Comcast SCH Holdings, LLC, 374 F.3d 1020, 1021 (11th Cir. 2004). Consequently, to establish Wal-Mart Stores East, LPs citizenship, Mr. Clark must properly allege the citizenship of each member of the limited partnership. Accordingly, on or before October 18, 2022, Mr. Clark shall please file an amended complaint that sufficiently indicates the citizenship of Wal-Mart Stores East, LP.
