The court concludes the complaint in this case should have been filed as an amended complaint in Hoff's first lawsuit. Additionally, the IFP Motion should have been docketed in the first lawsuit. Accordingly, the Clerk of Court is DIRECTED to: (1) REFILE the pleadings docketed as a new complaint #1 and IFP Motion here #2 ) as an amended complaint and IFP Motion in Case No. 23-cv-1587; and (2) CLOSE this action.
