January 31, 2024 Opinion or Order Filing 4 ORDER The plaintiff has filed an application to proceed in forma pauperis and a certified copy of his jail or prison account statements. (Doc. 2). It is ORDERED that the application is GRANTED pursuant to 28 U.S.C. 1915(b). The plaintiff has received in his account average monthly deposits of $ 170.20 and had an average account balance of $ 47.07 for the last six months. The court therefore assesses an initial partial filing fee of $ 34.04 under 28 U.S.C. 1915(b)(1). However, if he proceeds with this action and pays this initial partial filing fee, the plaintiff must make regular payments until he has paid the entire filing fee of $350. If he wishes to continue this action, the plaintiff is ORDERED to sign the attached Prisoner Consent Form and return it to the Clerk of Court, together with a check in the amount of the initial partial filing fee made payable to the "Clerk, United States District Court" within 30 days. If the plaintiff does not comply by this deadline, the court may dismiss this action without further notice, and the plaintiff will not be obligated to pay the $350 filing fee.
