Filing 9 ORDER - Before the Court is Defendant John McDermott's Motion to Dismiss (Doc. #6 ). In that motion, McDermott claims that Plaintiff's Complaint fails for two reasons. First. McDermott argues that Plaintiff's Complaint is an impermissible shotgun pleading. Plaintiff's Complaint is not a shotgun pleading. Therefore, to the extent that McDermott's motion is based on the prohibition of shotgun pleadings, it is DENIED. Second, McDermott states that "Plaintiff's Complaint fails to state a cause of action against the Defendant such that Plaintiff would be entitled to relief." (Doc. #8 ). However, McDermott's Brief does not develop this argument whatsoever. McDermott is therefore ORDERED to appear before the Court, in writing, and explain how the factual allegations in Plaintiff's Complaint fail to satisfy the elements of each of his claims.
