Filing 7 ORDER that the court having received prisoner consent form the Warden is directed to deduct Monthly Payments from Prison Account of Chris Dwayne Williams. Although the plaintiff returned a signed Prisoner Consent Form (Doc. #6 at 1), he informed the court that he asked his family to send the $8.90 filing fee as he does not have adequate funds in his prison account. The undersigned construes plaintiff's filing as a motion for permission to pay the initial filing fee when funds become available and GRANTS the motion as set forth within. Filing 5 ORDER - Plaintiff Chris Swayne Williams filed and application to proceed in forma pauperis and a certified copy of his jail or prison account statement (Doc. #4 ). The undersigned GRANTS the application pursuant to 28 U.S.C. 1915(b). The court therefore assesses an initial partial filing fee of $8.90. If he wishes to continue this action, the undersigned ORDERS Williams to sign the attached Prisoner Consent Form and return it to the Clerk of Court within 30 days. In his application to proceed in forma pauperis, Williams requests the appointment of counsel to pursue discovery and the "immediate transport from Bibb" Correctional Facility (Doc. #4 at 5). Accordingly, the undersigned DENIED WITHOUT PREJUDICE Williams's motion for appointment of counsel. To the extent Williams requests discovery, his request also merits denial.
