ORDER - Before the Court is Defendant Lincoln Heritage Life Insurance Company's Motion to Dismiss (Doc. #4 ). After the Motion was briefed, the Court directed the parties to brief whether the Complaint's contention that the policy was not yet in effect at the time of the insured's death had any effect of this case (Doc. #9 ). Plaintiff did not respond. The Court is therefore satisfied that this is not an issue in this case. Accordingly, Defendant's Motion to Dismiss (Doc. #4 ) is DENIED.
