Date Filed Document Text
April 11, 2024 Opinion or Order Filing 4 ORDER - Seeing as Plaintiff proceeds pro se, the Court granted Plaintiff fourteen (14) days to amend her Complaint (Doc. #3 ). Plaintiff did not comply with the Order and has yet to file an amended complaint. Therefore, the Court now DISMISSED Plaintiff's Complaint for failure to prosecute and, alternatively, for failure to state a claim. Costs taxed as paid. Signed by Judge L Scott Coogler on 4/11/2024. (MEB2)
March 26, 2024 Opinion or Order Filing 3 MEMORANDUM OF OPINION AND ORDER - The motion to proceed in forma pauperis (Doc. #2 ) is GRANTED IN PART insofar as Plaintiff requests to proceed without prepayment of fees, costs or security. However, there is no constitutional right to counsel in a civil case. Additionally, the Plaintiff writes that she has hired "attorney Gerard L. Truesdale." (Doc. 1.) Accordingly, the motion is DENIED IN PART insofar as Plaintiff requests appointment of an attorney. Accordingly, Plaintiff has not stated any facts which would give rise to a claim against any defendant. Plaintiff is granted fourteen (14) days from the date of this Order to amend her Complaint to state a claim upon which relief may be granted, to the extent she can do so. Signed by Judge L Scott Coogler on 3/26/2024. (MEB2)
