September 28, 2010 Opinion or Order Filing 242 ORDER - IT IS HEREBY ORDERED that Petitioner's second amended petition for writ of habeas corpus (Doc. 162) is DENIED WITH PREJUDICE. The Clerk of Court shall enter judgment accordingly. IT IS FURTHER ORDERED concluding that Claim 34 is procedur ally barred. Petitioner has not established cause and prejudice or that a fundamental miscarriage of justice will occur if Claim 34 is not reviewed on the merits. (Doc. 215.)
