Filing 163 ORDER - On July 18, 2012, the Ninth Circuit ordered this Court to reconsider, in light of Martinez v. Ryan, 132 S. Ct. 1309 (2012), its procedural default rulings on a number of claims alleging ineffective assistance of counsel at trial and sentencin g. (Doc. 139 .) Accordingly, IT IS ORDERED the procedural default of Claims 1-D, 1-H, and 17 is not excused under Martinez. IT IS FURTHER ORDERED expanding the record to include Exhibits 810 and 1221 to Petitioner's Supplement Brief. (Doc. [149 ]-1.) IT IS FURTHER ORDERED that the Clerk of Court shall forward of copy of this order to the Ninth Circuit Court of Appeals and shall terminate this matter, re 9CCA #07-99026 as to Notice of Appeal 135 .
