ORDER that Petitioner's motion for discovery Doc. # 55 , motion for appointment of counsel (Doc. #55) and motion for evidentiary hearing Doc. 67 are denied. FURTHER ORDERED that the Report and Recommendation is accepted and adopted, the objec tions are overruled (Doc. #56), the Petition in this case is denied, with prejudice, and the Clerk of the Court shall enter judgment accordingly. IT IS FINALLY ORDERED that pursuant to Rule 11 of the Rules Governing Section 2254 Cases, in the event P etitioner files an appeal, the Court denies issuance of a certificate of appealability because Petitioner has not made a substantial showing of the denial of a constitutional right.
