December 1, 2008 Opinion or Order Filing 31 ORDER granting Plas' 22 Motion for Judgment Upon Default. FURTHER ORDERED that the Clerk shall enter Default Judgment against dfts and in favor of Plas. FURTHER ORDERED that Dfts, their agents, servants and employees and all persons in active concert or participation with them are enjoined from: 1. Using, promoting, or advertising the SUN CITY Mark in connection with its realestate agency and brokerage services; and 2. Using the SUN CITY Mark in any way that indicates, suggests, represen ts or is likely to lead the public or individual members of the public to believe that Dfts are in any manner, directly or indirectly, associated, connected with, licensed, authorized,franchised or approved by Plas or Plas' licensees. FURTHER OR DERED that Dfts shall file with the Court and serve on Plas a report in writing under oath setting forth in detail the manner and form in which Dfts have complied with the injunction, within thirty days after service of such injunction. FURTHER ORDER ED that the Court retains jurisdiction over this matter. FURTHER ORDERED GRANTING Plas' Motion for Attorneys' Fees 29 . FURTHER ORDERED that Plas are awarded attorneys' fees in the amount of $5,919.00. FURTHER ORDERED that the Clerk of Court shall terminate this action.
