JUDGMENT in favor of Plaintiff Securities and Exchange Commission against Defendant Phillip M Young. Defendant is liable for disgorgement of $357,276.26, representing profits gained as a result of the conduct alleged in the Complaint, together w ith prejudgment interest thereon in the amount of $87,576.53, for a total of $444,852.79. Defendant shall satisfy this obligation by paying S444,852.79 within ten business days to the Clerk of this Court. Defendant shall pay a civil penalty in the amount of $50,000.00. ORDER - IT IS ORDERED that the Commission's 66 Motion for Summary Judgment is granted. FURTHER ORDERED that the Commission provide further briefing by1/16/10 regarding the amount of civil penalties that should be assessed against Richard Dabne y, Raymond Dabney, Charles Smith, and Phillip Young and the justification for any amounts proposed by the Commission. Dfts will then have until 1/30/10 to respond. FURTHER ORDERED that the Commission file a motion for entry of default jgm and submit a Proposed Final Jgm as to Dft Clifford Lewis by 1/16/10.
