Filing 237 ORDER. The Court is in the process of examining the issues of back and/or front pay. In that process it would be helpful to know the following information with respect to all employment held by Mr. Mamola since he was terminated by GMS. This information was apparently calculated by the parties' respective experts but not included in their testimony (at least the Court does not specifically recall it.) The requested information is: 1) the exact dates of Mr. Mamola's employment with each subsequent employer (The Court understands that pursuant to its earlier determinations and the stipulations of the parties Mr. Mamola's employment with K-2 is deemed to continue to the present at the rate and with the same benefits he held at his termination); 2) The method and rate of compensation, (e.g. hourly, salary, etc.), actually paid by each employer; and, 3), assuming a full year of employment at each employer what would have been the difference between the annualized FICA contribution paid for Mamola by GMS and the annualized FICA contribution paid for Mamola by Gibby, Arizona Precision, Advanced Integration Technologies, and K-2? The parties need not, but may if they wish, provide totals of these amounts through 2017 reduced for present value. If they provide this information they should so designate it. The parties should further specify whether there is any dispute with the testimony of Mr. Clarke that front pay should be discounted back to the estimated date of trial at 3.51%, and should further state the appropriate method by which such discounting should occur. The parties would be incorrect to presume that the Court has arrived at any particular determination as to their underlying arguments by this requested information. They are further ordered to submit this information to the Court no later than the end of the day October 20, 2010. If the parties cannot stipulate to the requested information as to any or all of the categories of the above-requested information, they should so state and submit their respective positions in writing as to each category of information. Filing 94 ORDER denying #56 Motion for Protective Order; denying #76 Motion for Protective Order> Pursuant to the parties' previous Motion for Protective Order [Dkt. # 56] the court held a telephonic conference with the parties after which it received a renewed motion for protective order [Dkt. # 76] from Defendant. Both the previous and the present motion result from Plaintiff's alleged refusal to sign a protective order agreed to by the parties, after that order had been revised to contain provisions insisted on by the Court to comply with 9th Circuit law. Defendant asserts that the parties agreed to be bound by the terms of the agreed upon order prior to its submission for approval to the court, and pursuant to that understanding it provided Plaintiffs with certain documents and materials that Plaintiffs, apparently, now allege they have no obligation to keep confidential. Nevertheless, Defendant does not seek to have the court order that such materials be kept confidential, rather the Defendant requests that the Court enter a broad protective order, similar to that previously agreed to by the parties, that would allow either party to designate any document as confidential, and would further allow either party to challenge that designation. Plaintiffs object to such a protective order and propose instead a protective order allowing only specific types of documents such as those containing employee social security numbers, medical information, business customer lists, trade secrets, manufacturing processes or other documents or categories of documents that the parties agree are confidential to be marked as confidential without specific reference to Fed. R. Civ. P. 26(c). While the Court is willing to enter a protective order that is in compliance with the law if the parties agree to it, in the absence of such agreement, a protective order must meet the requirements of Fed. R. Civ. P. 26(c) on a more particularized basis than that proposed by Defendant. Moreover, the examples of documents proposed by the Defendant that would comply with, and justify the protection of confidentiality, all seem to be covered by Plaintiff's proposed alternative confidentiality order. Defendant does not seek for the court to enter a confidentiality order as to those documents already provided pursuant to the deposition of Randy Babchuk, therefore the Court enters no such order. Further, the Court informs the parties in advance that if either party is unreasonable in agreeing to the confidentiality of documents clearly meriting such protection thus requiring the parties to apply to the Court for such protection on a piecemeal basis, the Court will impose the costs of seeking such protection on the party that does not prevail on the individual request.
