ORDER - For all of these reasons, although this court AFFIRMS the bankruptcy courts decision allowing defendant to recoup $27,412.50, it REVERSES and VACATES that decision insofar as that court awarded defendant a one-half interest in the commun ity property. As explained herein, the bankruptcy estate is entitled to 100 percent of the community property, $110,881.34, in defendants possession at the filing of debtors bankruptcy petition. The bankruptcy court is thus ordered to vacate its prior judgment and enter judgment in accordance herewith. (See document for further details). Signed by Judge Robert C Broomfield on 9/27/10. (LAD)
