ORDER that Dfts City of Phoenix, City of Phoenix Police Department, Jack Harris, Frank Fairbanks, and Joe Knott's Motion 2 to Dismiss is granted in part and denied in part as follows: Dft City of Phoenix Police Department is dismissed without prejudice as a party to this case; Plas' claims under Count II of the complaint is dismissed; Plas are precluded from recovering punitive damages in this case.
